Implementing ECHR judgments: New thematic factsheet on judicial independence

The Department for the Execution of Judgments of the European Court of Human Rights (ECHR) has published a new factsheet focusing on cases related to the independence and impartiality of the judicial system. The factsheet summarises measures reported by 21 member states to safeguard and reinforce the independence and impartiality of their national judicial systems in response to ECHR judgments concerning the right to a fair trial.

It includes a section on the independence and impartiality of prosecutors, which form an integral part of European judicial systems. This is the fifth in a series of thematic factsheets on the implementation of ECHR judgments. Previous examples cover constitutional matters, effective investigations into death or ill-treatment caused by the security forces, freedom of religion and the environment. Some of the factsheets are available in other languages in addition to English and French. (coe.int)

CJEU Ruling C-57/23: Police May Rely on Internal Rules to Store Suspect Data

Judgment of the Court of Justice in Case C-57/23 (Policejní prezidium): The police of a Member State may decide, on the basis of internal rules, whether it is ecessary to store the biometric and genetic data of a person accused or suspected of a criminal offence.  Where national law sets appropriate time limits for a review of the need to store those data, it does not necessarily need to provide for a maximum period of storage . A Czech public official was interviewed by the police in the context of criminal proceedings involving him. Despite his objections, the police ordered the taking of his fingerprints, the taking of a buccal smear on the basis of which the police established a genetic profile, the taking of photographs and the drawing up of a description of him. Protection of Lawyer Profession: Parliamentary Assembly gives green light to new Council of Europe treaty

Parliamentary Assembly has warmly welcomed the draft  Council of Europe Convention for the Protection of the Profession of Lawyer , pointing out that lawyers play a key role in administering justice and ensuring public confidence in the law. Approving an opinion based on a report by Vladimir Vardanyan (Armenia, EPP/CD), the Assembly said lawyers are increasingly becoming targets of harassment, intimidation and attacks. The new Convention requires states to protect them in various ways, allowing them to practise without fear of discrimination or interference. It also establishes standards for professional associations of lawyers and sets up a robust monitoring mechanism. Judicial Workload and Compensation: EU Law Does Not Mandate Extra Pay for Covering Vacant Posts (CJEU)

Judgment of the Court of Justice in Case C-272/24 (Tribunalul Galați) on 13.11.2025: A judge who carries out tasks which fall to a vacant post at his or her court, in addition to those within the remit of the post to which he or she has been appointed, is not necessarily entitled to financial compensation. The grant of a rest period to compensate for the additional work is, under certain conditions, an adequate measure. The Galați Regional Court (Romania) is understaffed due to various judicial posts remaining vacant. International Criminal Court terminates proceedings against Al-Tuhamy Mohamed Khaled following notification of his death

On 7th September 2022, Pre-trial Chamber I of the International Criminal Court (ICC) terminated proceedings against the alleged former Lieutenant General of the Libyan army and former head of the Libyan Internal Security Agency, Mr Al-Tuhamy Mohamed Khaled.  The Chamber made this decision following the Prosecution’s Notification of the Death of Al-Tuhamy and request to withdraw arrest warrant, dated 2 August 2022 and annexing a copy of a death certificate issued by the Libyan authorities and an official translation. In light of the Prosecution’s submissions, the Chamber considered that the certificate sufficed to render the warrant of arrest without effect. Outstanding requests for arrest and surrender made to any States will accordingly be withdrawn.
